These Terms and Conditions explain how bidding works at 765 Auction.
By registering, placing a bid, or participating in an auction, you agree to follow all of the rules below.

1. Registration & Bidding

• Each bidder number or username is personal, non-transferable, and tied to your account.

• You are responsible for all bids placed under your number, even if someone else uses it.

• By registering, you confirm you are legally allowed to enter this agreement and to bid on your own behalf or for someone you are authorized to represent.

2. Sales Tax

• State sales tax will be added to all purchases unless you provide a valid resale or tax-exempt certificate before bidding.

• We cannot refund tax after the auction if an exemption was not submitted in advance.

3. Payment

• All invoices must be paid in full within the time set by 765 Auction after the auction closes.

• Accepted payment methods: Cash, Certified Check (with Bank Letter of Guarantee), Wire Transfer, or Credit Card.

• Title and responsibility for the item transfer to you once payment is complete.

• Unpaid invoices may result in interest charges, collection fees, or loss of bidding privileges.

4. Buyer’s Premium

• A 15% Buyer’s Premium will be added to every winning bid unless otherwise stated during the auction.

• The Buyer’s Premium becomes part of the total purchase price and must be paid in full with the item.

5. Pickup & Removal

Pickup times are:

• Saturday: 10:00 A.M. – 2:00 P.M.

• Monday: 10:00 A.M. – 2:00 P.M. and 3:30 P.M. – 6:00 P.M.

If you cannot make these times, call or text 765-761-6431 before pickup to make arrangements.

Items not picked up on time may:

• Be charged storage or relocation fees, or

• Be forfeited without refund.

Once items leave our premises, all risk and responsibility belong to the Buyer.

6. Item Condition & Try Before You Buy

• All items are sold “AS IS, WHERE IS, WITH ALL FAULTS.”

• There are no guarantees or warranties of any kind.

• Descriptions and photos are our best opinions and are not guaranteed facts.

• Buyers are encouraged to inspect items carefully before bidding.

Try Before You Buy Policy

You may test or inspect your purchased items before leaving the building.
If the item does not match the condition described in the auction, it will be removed from your invoice before you leave.
Once you take an item off the premises, you accept it in its current condition — no refunds or adjustments will be made after that point.

7. Third-Party Pickup

If you send someone else or a shipping company to pick up your items, you must give us written or text authorization first.
After the item leaves our location, 765 Auction is not responsible for any loss, damage, or condition issues.

8. Auctioneer’s Rights

765 Auction reserves the right to:

• Reject any bid or bidder,

• Revoke a bidder’s number or bidding privileges,

• Withdraw or re-offer any item, or

• Resolve any disputes between bidders.

The Auctioneer’s decisions are final and binding.

9. Online & System Disclaimer

765 Auction is not responsible for errors, delays, or issues caused by internet outages, software failures, technical problems, or human error during online bidding.

10. Photo Usage Policy

All photos, videos, and promotional materials created by 765 Auction belong to us and are protected by copyright.
You may not copy, reuse, or repost our photos or listings without written permission.
Unauthorized use of our images may result in account suspension or legal action.

11. Severability

If any part of these Terms is found to be invalid, the rest will remain in full effect.

12. Modifications

765 Auction may update or change these Terms and Conditions at any time.
Updates take effect as soon as they are posted or announced.
