765 Auction Terms & Conditions

These Terms and Conditions explain how bidding works at 765 Auction.

By registering, placing a bid, or participating in an auction, you agree to follow all of the rules below.

1. Registration & Bidding

• Each bidder number or username is personal, non-transferable, and tied to your account.
• You are responsible for all bids placed under your account, even if someone else uses it.
• By registering, you confirm you are legally authorized to enter this agreement and to bid on your own behalf or for someone you are authorized to represent.

2. Sales Tax

• State sales tax will be added to all purchases unless a valid resale or tax-exempt certificate is submitted before bidding.
• Tax exemptions cannot be applied or refunded after the auction closes.

3. Payment

• By registering to bid, you authorize 765 Auction to charge the credit card on file for all purchases immediately following the close of the auction.
• Winning invoices will be automatically processed using the payment method on file unless otherwise announced.
• Accepted payment methods may include Cash, Certified Check (with Bank Letter of Guarantee), Wire Transfer, or Credit Card when approved by 765 Auction.
• Title and responsibility for purchased items transfer to the Buyer upon successful payment.
• Declined or failed payments may result in suspension or loss of bidding privileges and may be subject to collection efforts.

4. Buyer's Premium

• A 15% Buyer's Premium will be added to every winning bid unless otherwise stated.
• The Buyer's Premium becomes part of the total purchase price and must be paid in full.

5. Pickup & Removal

Pickup times are:

• Saturday: 10:00 A.M. – 2:00 P.M.
• Monday: 10:00 A.M. – 2:00 P.M. and 3:30 P.M. – 6:00 P.M.

If you cannot make these times, call or text 765-761-6431 before pickup to make arrangements.

Items not picked up during the designated pickup period may be considered abandoned.

No Refund Policy for Unclaimed Items

• All sales are final.
• Purchases that are not picked up will not be refunded.
• Failure to pick up an item does not relieve the Buyer of responsibility for payment.
• 765 Auction reserves the right to dispose of, relist, donate, or otherwise handle unclaimed items at its sole discretion without refund or compensation to the Buyer.
• Additional storage, handling, or relocation fees may be assessed when applicable.

Once items leave our premises, all risk and responsibility belong to the Buyer.

6. Item Condition & Try Before You Buy

All items are sold "AS IS, WHERE IS, WITH ALL FAULTS."

• No guarantees or warranties are expressed or implied.
• Descriptions and photographs represent our best opinion and are not guaranteed facts.
• Buyers are encouraged to inspect items prior to bidding.

Try Before You Buy Policy

You may inspect or test your purchased items before leaving the building.

If an item materially differs from the description provided in the auction listing, it may be reviewed by management and, if approved, removed from your invoice before leaving the premises.

Once an item leaves the property, it is considered accepted by the Buyer in its current condition. No refunds, exchanges, or adjustments will be made after removal.

7. Third-Party Pickup

If you authorize another person or shipping company to pick up your items, you must provide written or text authorization before pickup.

Once items leave our facility, 765 Auction is not responsible for loss, damage, shipping issues, or condition disputes.

8. Auctioneer's Rights

765 Auction reserves the right to:

• Reject any bid or bidder;
• Revoke bidding privileges at any time;
• Withdraw, re-offer, or regroup items;
• Resolve bidding disputes as it deems appropriate.

The Auctioneer's decisions are final and binding.

9. Online & System Disclaimer

765 Auction is not responsible for interruptions, delays, technical issues, internet outages, software failures, clerical errors, or other circumstances beyond its control that may affect bidding or auction operations.

10. Photo Usage Policy

All photos, videos, descriptions, and promotional materials created by 765 Auction are the property of 765 Auction and are protected by copyright law.

Unauthorized copying, reproduction, distribution, or reuse of auction content is prohibited and may result in account suspension and/or legal action.

11. Severability

If any provision of these Terms and Conditions is determined to be invalid or unenforceable, all remaining provisions shall remain in full force and effect.

12. Modifications

765 Auction reserves the right to modify these Terms and Conditions at any time.

Changes become effective immediately upon posting or announcement and apply to all future auctions.
